General conditions of Sale

1. General information

The sale of products (hereafter: “Products”) offered on the website www.feetclick.com (hereafter: “Site”), is governed by these general conditions of sale (hereafter: “General Conditions”) and takes place between the Antony srl company and the buyer.

2. Commercial Policy

2.1 The sale of the Products is mainly addressed to natural persons who are final consumers consumers (hereinafter: “Customers”). Customer means the adult person who acts for purposes unrelated to commercial, entrepreneurial or professional activity carried out.

2.2 In consideration of the above, Antony srl reserves the right not to proceed with purchase orders (hereinafter: “Orders”) coming from subjects other than Customers.

2.3 In any case, if the order is made by a person not qualified as a consumer, these General Conditions will apply, but notwithstanding the provisions of the same:

a) the purchaser will not be granted the right of withdrawal pursuant to article 8 below;

b) will not find application as provided for in the subsequent art. 9 regarding liability for defective products;

c) the buyer will not be recognized any other protections and guarantees provided for by these General Conditions, which comply with mandatory provisions of law in favor of the consumer.

2.3 The presentation of the Products on the Website is not binding for Antony srl and does not constitute an offer to the public, but must be understood as a mere invitation to the Customer to formulate a purchase contract proposal.

2.4 Antony srl may at any time modify or amend these General Conditions. In any case, the Customer will be required to accept only the General Conditions in force at the time of the conclusion of each order.

2.5 The Order transmitted by the Customer through the Site has the value of a contractual proposal addressed to Antony srl and is governed by these General Conditions, which constitute an integral part of the Order and must be accepted by the Customer in full and without reservation.

2.6 The purchase proposal of the Customer is accepted by Antony srl, by sending an e-mail confirming the Order to the e-mail address stated at the time of registration on the Website (hereafter: “E- email “). The purchase contract is considered finalized when the customer receives the e-mail.

2.7 Each Order may relate to one or more Products, without prejudice to Antony srl’s right to provide a maximum number according to the product category.

2.8 Antony srl reserves the right not to ship orders if addressed to a post office box or if it is not possible to identify the private individual to whom the Order is addressed and the relative address.

2.9 All communications that are indicated in the General Conditions by e-mail will be sent to the e-mail address indicated by the Customer during registration.

3. Method of purchase

3.1 Each Product offered for sale, can be selected on a special web space that will display the photographic images, the unit price including VAT, the colors and the different sizes available.

3.2 The images and colors of the Products offered for sale may, in some cases, not correspond to the real ones due to the technical characteristics and resolution of the equipment and software provided by the computer used by the Customer. The images and colors, therefore, must be considered as indicative and exemplary but we invite the Customer to verify the effective adherence of the selected Product to their expectations. Antony srl will not therefore be responsible for the possible inadequacy of the images or colors of the Products due to the aforementioned technical reasons.

3.3 The Customer to execute each Order relative to the selected Products must carefully follow the instructions and procedures made available on the Site.

3.4 The Customer is requested to verify the accuracy of the content of each Order before confirming the same, completing the purchase form according to the instructions provided
on the corresponding page of the Site. At the same time each Order is requested, the Customer will be asked to confirm that you have read carefully and accept these
General Conditions. In case of non-acceptance of the General Conditions and any eventualities it will not be possible to conclude the Order.

3.5 If the Customer wants to make changes or corrections to his Order before confirming the same, he must request it from Antony srl, by writing to the e-mail address orders@feetclick.com or by contacting Customer Service at: +39 333 5973525. Generally, the confirmed order will not be further modifiable or cancelable, except in the cases expressly provided for by the General Conditions, or in any case in the cases required by the applicable Italian law.

3.6 At the end of the purchase procedure it is advisable to download, save or print the General Conditions in force at the date of conclusion of the same and any specific provisions (hereafter: “Specific Forecast”). The Customer will also receive an e-mail confirming the receipt of the order, containing a summary of the information already contained in the order form that is the customer data and shipping methods / addresses, and the essential characteristics of each product purchased as well as detailed indication of the price and delivery costs.

3.7 The Customer may at any time monitor the status of his Order by entering the “Customer Area” reserved area, or by calling the Customer Service telephone number (hereinafter: “Customer Service”) indicated on the Website in the “Contact” section.

4. Prices and methods of payment

4.1 The prices of the Products offered for sale and indicated on the Website are expressed in Euro and inclusive of VAT.

4.2 The total amount of each Order will also include shipping costs calculated as specified in Article 7. Shipping costs below.

4.3 Antony srl reserves the right to change the prices of the Products offered for sale at any time and without notice. In any case, the prices published on the Site will be applied to the Customer upon confirmation of each Order.

4.4 The payment of the Products can be made by credit card or debit card enabled to all the main circuits, via PayPal or cash on delivery (only orders for Italy), directly to the carrier, at the time of delivery. In the latter case, a surcharge of € 8.00 is foreseen.

4.5 Payment transactions by credit card will be governed by the regulations adopted by the individual credit card circuits.

4.6 The confirmation of the successful outcome of each Order will take place only after verification of the credit card data of the Customer and following receipt of the authorization to make the charge on the said credit card. The charge on the Customer’s credit card will be made exclusively following the shipment of the products of each Order.

4.7 For the preventive commitments of the credit card “ceiling” in case of cancellation of the Orders or of their positions, the contractual clauses of the single operators of the credit card circuits will be valid.

4.8 The credit card data will be handled with the utmost confidentiality directly by the operator of the circuit. Antony srl is not responsible for any fraudulent and illegal use of credit cards by third parties upon payment of the products purchased on the website www.feetclick.com. In this regard, Antony srl reserves the right to cancel the transaction in the suspected case of fraudulent use of credit cards. To guarantee greater security, additional information or documents may be requested at any time without which Antony srl reserves the right not to accept the transaction.

4.5 Together with the Products, the Customer will receive the order receipt relating to the purchase. It, together with proof of delivery delivered by the courier, is considered valid for all purposes as a receipt. The invoice must, however, be previously and specifically requested at the time of placing the order. To do this, you must forward the billing request, with all the necessary data, to the email address orders@feetclick.com.

5. Feetcodes and Credit Codes

5.1 Introduction
The Customer acknowledges that within the platform there is a system of codes and credits that allow purchases to be made at a reduced price compared to what is indicated in the product catalog. The system is available only within the feetclick.com site and is reserved for registered users. The methods of use are specified on the site in the credits section, may vary over time, are unquestionably defined and at the total discretion of Antony s.r.l., who reserves the right to modify the terms of use at any time.

5.2. Feetcodes codes
The Feetcodes are alphanumeric codes which, in themselves, do not give any right to any discount and serve exclusively as a reference for the generation of credits to be spent within the site feetclick.com. Each registered user has at his disposal one or more personal Feetcodes that he can share outside the site in order to earn credits for his account. To carry out this procedure, the site includes some features such as “Share your Feetcode”, “Share on Facebook”, “Twitter” and other social networks. Antony s.r.l. it may also issue Feetcode at its discretion on the occasion of certain marketing and promotion activities. The use and availability of Feetcodes are established at the sole discretion of Antony s.r.l ..

5.3. Credits
Credits are virtual tokens to be used in the cart that allow you to take advantage of a fixed price purchase on the feetclick.com site, the credits thus entered will be automatically deducted at the time the order is concluded. Each credit is applicable to only one product, any shipping costs are excluded. In the same order it is possible to use several credits simultaneously, one for each product. The credits will apply automatically only to the items included in the promotions. The credits are generally usable by the user for a limited period of time, after which they will no longer be usable. The credits can be used at the discretion of Antony s.r.l., who reserves the right to change the value, the deadline and to revoke them at any time. The credits could be subject to a minimum amount of expenditure under which the use of the same will not be possible. The credits are personal and linked to the account of the user who generated them and can be used for a single order, after which they will be automatically invalidated.
The credits earned can only be redeemed once, in case of return the credits are not returned. The credits cannot be sold, transferred and / or transferred to third parties.
Antony s.r.l. reserves the right to cancel any previously issued credit, even before the expiration, without the obligation of having to justify the reason and without the right to indemnity or compensation.
Antony s.r.l. it may also issue credits at its discretion in favor of users who will invite acquaintances, friends and family members to view the site’s offers and register on the same. For each new guest who registers on the site within a given time period, Antony s.r.l. can grant the user a credit, of the value determined from time to time at the discretion of Antony s.r.l. to be used on your account for a subsequent purchase.
Antony s.r.l. reserves the right to eliminate the credits issued in favor of users who make improper use of them, without prior notice and without the right to compensation or compensation.
The credits cannot in any way be converted into money, are in no way a virtual currency, have no value and are non-refundable.

6. Availability of Products

6.1 The Customer acknowledges that the stocks of Products offered on the Website are limited.

6.2 Occasionally, the non-availability of one or more Products may occur. In this case, Antony srl will inform the Customer as soon as possible, and in any case no later than 10 (TEN) working days from receipt of the Order, by telephone or e-mail.

6.3 In the event that the Order as a whole is not available, Antony srl will contact the Customer as soon as possible, by telephone or e-mail, and inform the Customer that the Order can not be processed.

6.4 In the event that the Order is partially unavailable (one or more Products not available), Antony srl will contact the Customer as soon as possible, by telephone or e-mail, and will inform you about the items not available. The partial order will still be processed, unless specifically requested by the Customer at the email address: orders@feetclick.com or at the phone number: +39 333 5973525.

6.5 In case of cancellation of the Order, no charge will be made on the Customer’s credit card. If the charge had already occurred, the crediting will be made as soon as possible and in any case according to the policies of the individual credit card circuit operators.

6.6 It remains expressly understood that, when each Order is transmitted to the internal structure of Antony srl responsible for its evasion, an e-mail of effective acceptance will be sent to the Customer. In some cases (particularly short order processing times), the mail in question will be replaced directly by a shipping confirmation.

7. Transportation and delivery

7.1 Antony srl will do its best to fulfill each Order within 1 (ONE) working day and in any case within the deadline of 10 (TEN) working days starting from the business day following the one in which the Customer has transmitted the Order.

7.2 When the package with the ordered Products leaves the warehouse of Antony srl, Antony srl will send an e-mail to the Customer.

7.3 The Customer can track the status of evasion of each of his Orders through the appropriate procedures in the Customer area.

7.4 The Customer Service is available to the Customer to provide assistance on the status of the Order and for any problems related to the delivery (except during holidays and company closing periods) and can be contacted by writing an email orders@feetclick.com.

7.5 The Customer must check the Products immediately upon delivery to ascertain their conformity with the order.

7.6 Any anomalies (such as tampering, damage to the packaging, damaged Products, missing or different products compared to those ordered and / or indicated in the shipping document) must be specifically described in writing directly on the delivery document to be signed by the Customer .

8. Shipping costs

8.1 The shipping service is offered to the customer free of charge for all shipments with destiny within the Italian territory or charged for the lump sum amount of € 9.90 for all shipments with destination within the member states of the EU (Italy excluded). These expenses may be modified at the discretion of Antony srl.

8.2 The shipping costs will be displayed, together with the other costs related to the purchase, at the conclusion of the procedure for completing each Order and prior to confirmation.

9. Right of withdrawal

9.1 The Customer has the right to withdraw from each Order concluded, without any penalty and without specifying the reason, within the peremptory deadline of 14 (FOURTEEN) working days,
starting from the day of receipt of the Products.

9.2 The Customer can withdraw from the Order in whole or in part.

9.3 To exercise the right of withdrawal, the Customer must complete the appropriate form in the “Resource Center” section of the Site.

9.4 To exercise the right of withdrawal, the customer must return the products to Antony srl, delivering them to the courier for shipping, no later than the mandatory deadline
of 5 (FIVE) working days from the date of sending the return request.

9.5 It is understood that: the return costs, with the exception of the cases indicated in paragraph 8.6 and 8.7, of the products are borne by Antony srl and that any costs incurred at the time of purchase for shipment will be reimbursed except for the surcharge charged if the mark was chosen as the payment method.

9.6 Antony srl reserves the right to withhold from the refund, in whole or in part, the amount of the costs incurred for the return shipment, to be considered equal to € 7.76 for Italy and € 15.94 for foreign countries, in following cases:

a) In the event the Customer uses a package of greater size and weight than that received with the product.

b) In the event of a hijacking of the package by the Customer, additional services requested by the Customer to the courier or storage due to the Customer’s non-cooperation.

c) In case of postponement, by agreement between Customer and courier, the date of the return shipment and it will be later than 5 (FIVE) working days with respect to the date on which the return
request was made.

9.7 In the event that the customer sends the product at his own expense or without using the procedure indicated in the “Return Center” section of the Site, the costs for return shipping will not be reimbursed and will be charged to the Customer. In this case the shipment will be considered under the responsibility of the Customer.

9.8 Any amount withheld from the reimbursement relating to the exceptions mentioned in paragraph 8.6, is subject to change and will be documented at the request of the purchaser. Antony srl reserves the right to change the amounts relating to the return costs mentioned in paragraph 8.6 following any changes to the agreements between Antony srl and the transport companies.

9.9 The right of withdrawal, in addition to compliance with the terms and conditions set out above, is correctly exercised if the following conditions are fully met:

a) the Products must be returned in their original state and packaging;

b) the identification tag must still be attached to the Products (where applicable).

9.10 Antony srl will verify that the returned Products are actually in their original condition. In particular, the return of Products that have been worn, washed or damaged will be refused. In this case, Antony srl will not accept the returned Products and it will be the customer’s responsibility to collect, either personally or by courier, such Products that will remain available to the Customer for 30 (THIRTY) days following the notification of return refused at the Antony srl warehouses

9.11 In case of exercise of the right of withdrawal, as indicated above, and verified that the Products are in their original condition, Antony srl will reimburse the amounts already debited to the Customer in the shortest possible time and in any case within 14 (FOURTEEN) days from the date in which has become aware of the Customer’s right of withdrawal. The amounts will be considered reimbursed within the terms if they are actually credited with a currency not later than the expiration of the aforementioned term. Antony srl can not in any way be held responsible for delays in the actual re-crediting due to the Banking Institute.

9.12 Antony srl will refund to the Customer the value of the returned goods, including shipping costs.

10. Responsibility for defective products

10.1 Pursuant to the provisions of Italian law and in particular of Legislative Decree 206 of 6 September 2005 (Consumer Code), Antony srl is responsible for any defect in the Products, including non-compliance of products that have been received by the Customer with respect to to those offered on the Site and ordered.

10.2 The Customer loses the rights specified below, if he fails to report the defect to Antony srl within two months from the acknowledgment of the same.

10.3 The Customer, in accordance with Article 130 of the Consumer Code, in the event of a defect, has the right to obtain the restoration of the goods at no cost, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract relating to the disputed products.

10.4 The return costs for defective Products or for the non-compliance of the Products with respect to the Order, will be borne by Antony srl.

11. Return of Products

11.1 If one or more of the Products delivered do not correspond to those ordered or are damaged, without prejudice to the provisions of art. 6.6, the Customer is obliged to promptly inform Antony srl, by writing to the e-mail address orders@feetclick.com

11.2 Products must be returned in their original condition and packaging. It is at the discretion of Antony srl to determine whether a Product is new or has been used by the Customer.
In the latter case, Antony srl will not accept the returned Product and it will be the customer’s responsibility to collect, either personally or by courier, such Products that will remain available to the Customer for 30 (THIRTY) days following the notification of return refused at the warehouses Antony srl

11.3 For the return of the product, the customer will delegate the organization of the shipment to Antony srl, otherwise shipping costs will be charged to the customer.

11.5 Once the Products have been received at the Antony srl Warehouse and the conditions described in point 10.2 have been verified, Antony srl will reimburse the amounts already debited on the Customer’s credit card or PayPal account in the shortest possible time and in any case within 14 (FOURTEEN ) days from the date of receipt of the products at the warehouse.

12. Applicable law and disputes

12.1 The General Conditions and any Specific Predictions are governed by Italian law and will be interpreted according to it.

12.2 In the event of a dispute of any kind and nature inherent to the General Conditions, any specific Predictions and Orders shall be the Court of the place of domicile or residence of the Client according to the applicable law, or at the discretion of the same, the Court of Milan .
